TERMS OF SERVICE

1. Overview
These Terms of Service govern your access to and use of the Littomaker website, store, products, and related services.
“Littomaker,” “we,” “us,” and “our” refer to Littomaker, a trade name operated by 8020edu LLC, a Texas limited liability company. Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and services to you.
By visiting our website, submitting artwork, creating an account, or placing an order, you agree to these Terms of Service and the policies incorporated into them, including our Privacy Policy, Return and Refund Policy, and Shipping Policy. If you do not agree, do not use the website or place an order.
2. Eligibility and Account Information
You represent that you are at least the age of majority in your state of residence or are using the website with the permission and supervision of a parent or legal guardian.
You agree to provide accurate, current, and complete information when placing an order or creating an account, including your name, email address, billing information, shipping address, and payment information.
You are responsible for protecting your account credentials and for activity performed through your account. You may not sell, transfer, assign, or license your customer account to another person.
3. Products
We make reasonable efforts to accurately describe and display our products. However, colors and product appearance may vary because of screen settings, device displays, printing processes, materials, lighting, and manufacturing tolerances.
Product descriptions, features, sizes, materials, quantities, prices, production times, and availability may be changed at any time without prior notice.
We may discontinue a product, limit purchase quantities, restrict sales to particular locations, or refuse an order when reasonably necessary.
4. Orders and Acceptance
Submitting an order is an offer to purchase the selected products. An order is accepted after payment is successfully authorized and we send an order confirmation.
We may cancel, decline, or place an order on hold for reasons including:
- Payment authorization problems
- Suspected fraud or unauthorized use
- Pricing or product-information errors
- Unavailable materials or production capacity
- Prohibited or potentially infringing artwork
- Incomplete customer information
- Inability to fulfill the order as requested
If we cancel an order after payment has been collected, we will refund the canceled amount to the original payment method.
Please review all product selections, quantities, shipping information, artwork, and instructions before submitting an order.
5. Custom Artwork
Ownership and Permission
You retain ownership of artwork that you submit.
By submitting artwork, you grant Littomaker a limited, nonexclusive, royalty-free license to copy, resize, crop, adjust, reproduce, and otherwise process the artwork only as reasonably necessary to:
- Prepare an artwork proof
- Communicate with you about the order
- Manufacture the ordered products
- Package and fulfill the order
- Maintain order and production records
- Address quality-control, refund, reprint, or dispute issues
We will not use customer artwork for advertising, portfolio displays, social media, or promotional materials without permission.
Customer Representations
You represent and warrant that:
- You own the artwork or have permission to use, reproduce, and submit it
- Producing the artwork will not infringe another person’s copyright, trademark, privacy, publicity, or other rights
- The artwork does not violate any law
- The artwork does not contain malicious code or harmful files
- The information you provide about the artwork is accurate
You are responsible for obtaining licenses or permissions required for logos, photographs, characters, trademarks, fonts, illustrations, or other protected content.
Prohibited Artwork
We may refuse, cancel, or request changes to artwork that we reasonably believe:
- Infringes intellectual-property rights
- Is unlawful, fraudulent, threatening, defamatory, or deceptive
- Promotes violence, illegal activity, exploitation, or abuse
- Contains hateful or discriminatory content
- Contains obscene or sexually exploitative material
- Violates Shopify’s acceptable-use requirements
- Could expose Littomaker, 8020edu LLC, Shopify, or another party to liability
Refusal to produce artwork does not mean that we have made a legal determination regarding ownership or infringement.
6. Artwork Proofs and Approval
When a proof is provided, you are responsible for reviewing:
- Spelling and grammar
- Names, dates, and contact information
- Design placement and orientation
- Cut lines and borders
- Background removal
- Size and dimensions
- Quantity
- Colors
- Images and logos
- Any requested changes
Production may not begin until the proof is approved.
Approval authorizes production and confirms that the proof is acceptable. We are not responsible for errors that were visible in an approved proof.
Changes requested after proof approval may be refused or may require an additional fee. Once production begins, an order generally cannot be changed or canceled.
Screen colors may differ from printed colors. Minor variations in color, cut alignment, dimensions, border width, material, finish, and placement that are customary in sticker production are not considered defects.
7. Prices, Taxes, and Payment
Prices, discounts, and promotions may change without notice. The amount charged will be the amount shown at checkout when the order is submitted.
Applicable sales tax is calculated and collected at checkout based on the order and delivery information.
You agree to provide accurate payment information and represent that you are authorized to use the payment method submitted.
We may correct pricing, calculation, or product-information errors. If an error materially affects an order after it is placed, we may contact you for approval, adjust the order with your consent, or cancel and refund the affected order.
8. Production and Shipping
Production normally takes 3–5 business days after artwork proof approval, unless a different timeline is stated or communicated.
Production and delivery dates are estimates and are not guaranteed. Delays may result from:
- Delayed artwork submission or proof approval
- Required artwork corrections
- Material or equipment availability
- High order volume
- Carrier delays
- Weather
- Holidays
- Events outside our reasonable control
Shipping rates and estimated transit times are described in our Shipping Policy and at checkout.
You are responsible for providing a complete and accurate delivery address. Additional charges may apply if an order must be reshipped because of an incorrect or incomplete address.
Unless otherwise required by law, title and risk of loss pass to you when the carrier records delivery to the address provided with the order.
9. Cancellations, Returns, Reprints, and Refunds
Custom products are made specifically for each customer and generally cannot be resold.
Cancellation requests must be submitted before proof approval and before production begins. We cannot guarantee that a cancellation or change can be completed.
Once a proof is approved or production begins, the order is final sale except when the product is damaged, defective, incorrect, or materially different from the approved proof.
Eligibility for cancellations, replacements, reprints, returns, and refunds is governed by our Return and Refund Policy, available through the footer of our website.
Nothing in these Terms limits rights that cannot legally be waived.
10. Website Intellectual Property
The website and its content, including Littomaker branding, logos, text, graphics, layouts, photographs, illustrations, software, design elements, and product information, are owned by or licensed to Littomaker, 8020edu LLC, Shopify, or their respective licensors.
You may use the website only for lawful personal or business purchasing purposes.
Without prior written permission, you may not:
- Copy or reproduce website content
- Modify or create derivative works from website materials
- Sell, license, or commercially exploit website content
- Use Littomaker names, logos, or branding
- Scrape, extract, or systematically collect website data
- Circumvent website security or access restrictions
Customer artwork remains governed by Section 5 and is not transferred to Littomaker merely because it is uploaded.
11. Third-Party Services and Links
The website may use or link to third-party services, including payment processors, shipping carriers, analytics providers, social-media platforms, and file-storage services.
Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party websites, content, availability, security, or conduct.
Use of third-party tools is at your own risk, except to the extent responsibility cannot be excluded under applicable law.
12. Relationship With Shopify
Littomaker is powered by Shopify, which provides the ecommerce platform used to operate the store.
Purchases made through the store are transactions directly between you and Littomaker. Shopify is not the seller of Littomaker products and is not responsible for product design, production, fulfillment, quality, refunds, replacements, injuries, losses, or disputes arising from a Littomaker order.
13. Privacy
Personal information collected through the website is handled according to our Privacy Policy, available through the footer of our website.
Because Shopify hosts the store, information submitted through the website may be processed by Shopify and other service providers that assist with payments, fraud prevention, file uploads, fulfillment, communications, analytics, and store operation.
By using the website, you acknowledge the processing practices described in our Privacy Policy.
14. Reviews and Feedback
If you submit a review, suggestion, testimonial, comment, or other feedback unrelated to order artwork, you grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, edit, publish, display, and distribute that feedback for business and promotional purposes.
You represent that submitted feedback:
- Is truthful and based on your experience
- Does not violate another person’s rights
- Does not contain unlawful, defamatory, abusive, or misleading content
- Properly discloses any compensation or incentive received
This feedback license does not authorize promotional use of customer artwork without separate permission.
15. Prohibited Uses
You may not use the website or services to:
- Violate any law or regulation
- Infringe intellectual-property or privacy rights
- Submit false, deceptive, or fraudulent information
- Engage in unauthorized payment activity
- Upload malware, viruses, or harmful code
- Interfere with website operation or security
- Attempt unauthorized access to accounts, systems, or data
- Harvest or track personal information without authorization
- Impersonate another person or entity
- Send spam, phishing messages, or unauthorized solicitations
- Use automated tools to bypass purchasing, security, or access controls
- Engage in conduct that could harm Littomaker, 8020edu LLC, Shopify, customers, or third parties
We may suspend access, cancel orders, or report conduct when we reasonably believe a prohibited use has occurred.
16. Errors and Corrections
The website may occasionally contain errors, inaccuracies, or omissions involving product descriptions, prices, quantities, promotions, availability, production times, shipping charges, or other information.
We may correct errors, update information, or cancel affected orders at any time. If payment has already been collected for a canceled order, the applicable amount will be refunded.
17. Disclaimer of Warranties
To the fullest extent permitted by law, the website and services are provided “as is” and “as available.”
Except for obligations expressly stated in these Terms, our published policies, or applicable law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free website operation.
We do not warrant that:
- Website access will always be uninterrupted or secure
- All website information will be error-free
- Products will appear identical to images displayed on a screen
- Production or delivery will occur by a guaranteed date
- Products will satisfy an intended use that was not disclosed and accepted before ordering
This section does not exclude warranties or rights that cannot legally be excluded.
18. Limitation of Liability
To the fullest extent permitted by law, Littomaker, 8020edu LLC, Shopify, and their owners, managers, employees, agents, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, lost business opportunities, or replacement costs.
To the fullest extent permitted by law, Littomaker’s total liability arising from an order will not exceed the amount paid for the product giving rise to the claim.
These limitations do not:
- Eliminate remedies expressly provided in our Return and Refund Policy
- Apply to fraud, intentional misconduct, or gross negligence where liability cannot legally be limited
- Limit rights or remedies that cannot legally be waived
19. Indemnification
You agree to indemnify, defend, and hold harmless Littomaker, 8020edu LLC, Shopify, and their owners, managers, employees, agents, contractors, affiliates, and service providers from third-party claims, losses, liabilities, damages, costs, and reasonable attorneys’ fees arising from:
- Artwork or content you submit
- Your lack of permission to reproduce submitted artwork
- Your violation of another party’s intellectual-property, privacy, or publicity rights
- Your violation of these Terms
- Your violation of applicable law
- Your misuse of the website or services
We will provide reasonable notice of an indemnifiable claim and may control the defense and settlement, provided that we will not agree to nonmonetary obligations imposed directly on you without your reasonable consent.
20. Events Outside Our Control
We are not responsible for delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, fire, utility failures, internet outages, equipment failure, labor disruption, supply shortages, government action, transportation interruption, carrier delay, civil disorder, war, terrorism, epidemic, or pandemic.
We will make reasonable efforts to communicate material delays and determine an appropriate resolution.
21. Termination
We may suspend or terminate access to the website or services if you violate these Terms, engage in unlawful or harmful conduct, or create risk for Littomaker, 8020edu LLC, Shopify, customers, or third parties.
Termination does not eliminate obligations or liabilities that arose before termination.
Sections concerning artwork rights, intellectual property, disclaimers, liability, indemnification, dispute resolution, and other provisions that by their nature should survive will remain effective.
22. Governing Law and Venue
These Terms and transactions with Littomaker are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
Except where applicable consumer law requires otherwise, legal proceedings arising from these Terms or the services must be brought in the state or federal courts serving Collin County, Texas, and the parties consent to jurisdiction and venue in those courts.
23. Severability
If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain effective.
24. Waiver and Entire Agreement
Failure to enforce a provision does not waive the right to enforce it later.
These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any additional terms displayed during checkout, constitute the entire agreement relating to use of the website and purchases from Littomaker.
If a product-specific term or written agreement conflicts with these Terms, the more specific term will control for that transaction.
25. Assignment
You may not assign or transfer your rights or obligations under these Terms without our written consent.
We may assign or transfer these Terms in connection with a merger, reorganization, sale of assets, change of control, or transfer of the Littomaker business.
26. Changes to These Terms
We may update these Terms by publishing a revised version on the website.
Changes apply prospectively from the stated effective date. The Terms in effect when an order is placed will generally govern that order, except when a change is required by law.
Continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms.
